New Delhi: ED has opposed the interim bail plea of Delhi Chief Minister Arvind Kejriwal. ED filed an affidavit in the Supreme Court saying that campaigning for elections is not a fundamental right. The ED said in its affidavit that the right to campaign for elections is neither a fundamental right, nor a constitutional right nor a legal right. No politician has been granted interim bail to contest elections. Even if he is a candidate contesting elections.

ED put this argument before the court

The ED said this would set a precedent which would give all unscrupulous politicians an opportunity to commit crimes under the guise of elections and escape investigation. Politicians have contested elections in judicial custody and some have even won, but they have never been granted interim bail on this ground.

ED put this argument in the court

ED said in its affidavit that a total of 123 elections have been held across the country in the last 5 years. If leaders are given bail on the basis of campaigning in elections, then neither any leader will be arrested nor will he be sent to judicial custody, because there is always some election taking place in the country.

The court will give its verdict on Friday
